These General Terms and Conditions of Sale are agreed between Craft Gardens, represented by Marta Ramada Leite, with registered office at Rua Tomáz Ribeiro, No. 751, 2nd Left, 4450-290 Matosinhos, tax identification number 223819166 and contact +351 933 004 042, hereinafter referred to as “Craft Gardens”, and the persons who wish to make purchases through the website www.craftgardens.pt, hereinafter referred to as the customers.

The Craft Gardens service consists of making available and supplying a set of products and/or services, enabling the user, to whom the status of customer is attributed, to order and purchase online the products presented therein.

Use of Craft Gardens implies full acceptance of and agreement with all the parameters set out in these Terms and Conditions, as well as with the Privacy Policy in force at the time of access to Craft Gardens.

The parties agree that purchases made through the website www.craftgardens.pt shall be governed exclusively by this contract, to the exclusion of any conditions previously available on the website.

If you do not accept, in whole or in part, any of the stipulated conditions, you should not make purchases at Craft Gardens. By accessing Craft Gardens, you undertake and accept responsibility for complying with the conditions set out on this page and in the Privacy Policy.

Craft Gardens reserves the right to update and amend the Terms and Conditions without prior notice. It is advisable to check the Terms and Conditions periodically to verify any changes or updates.

Intellectual Property

The content of this website, including trademarks, designs, logos, text, images, audio and video materials, is the property of Craft Gardens, unless otherwise indicated by reference to its source, and is protected under general legal provisions and national and international legislation on the protection of intellectual property. It is not permitted to display, reproduce, distribute, modify, transmit or otherwise use the content of this website, in any form whatsoever, for any public or commercial purpose, without the prior express written authorisation of Craft Gardens.

You may only use the information, text, figures or graphics contained on this website for your personal use, and never for commercial purposes, and you must not reproduce, modify, transmit, authorise or publish such information, in whole or in part, for any purpose, without the prior written authorisation of Craft Gardens.

Product and Price Information

Craft Gardens informs customers about the characteristics, descriptions, images or videos of each product and/or service on each respective page. Craft Gardens undertakes to present its products and/or services clearly and to correct any possible errors as quickly as possible. Craft Gardens presents, in a concise manner, the prices of each product and/or service, including VAT, shipping costs applied to each order, and any other additional costs that may apply.

Information on products, prices, content, images, videos, promotional campaigns and services may be updated and changed by Craft Gardens at any time.

The customer undertakes to fully respect the conditions and rights referred to herein and to refrain from any acts that may be contrary to the law and to rights such as copyright, related rights, and other applicable legislation regarding the use of images, videos, content, etc., without the express approval of Craft Gardens. Craft Gardens cannot be held liable for any improper use of such products.

Purchase Conditions at Craft Gardens

ARTICLE 1 – OBJECT

  1. These General Terms and Conditions of Sale aim to provide and define all the information necessary for the User regarding the procedures for ordering, selling, payment and delivery of purchases made on the website www.craftgardens.pt.

  2. These conditions govern all the steps necessary to place an order and ensure the follow-up of such order between the Contracting Parties.

ARTICLE 2 – ORDER

  1. The User places an order by completing the purchase process presented on the website www.craftgardens.pt, adding the product(s) or service(s) they wish to order to the shopping basket.

  2. To submit an order, the User must:

    a) Register on the website www.craftgardens.pt, providing the information requested therein.
    b) Log in by providing the e-mail address and password chosen at the time of registration.
    c) Complete the information and choose the options made available throughout the checkout process (delivery and billing address, shipping method, payment method, as well as the tax number and name to appear on the invoice for tax purposes).

  3. Final confirmation of the order by the User constitutes full and complete acceptance of the prices and description of the products available for sale, as well as of these General Terms and Conditions of Sale, which shall be the only ones applicable to the contract thus concluded.

  4. Craft Gardens will honour online orders only up to the limit of available stock. In the event of product unavailability, Craft Gardens undertakes to inform the User as soon as possible.

  5. The details shown on the invoice are the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.

  6. Order requests are valid for 30 (thirty) days, except when the order is placed under a promotional campaign that defines a different deadline, and it is not possible to guarantee prices, discounts, promotions or offers beyond this period.
    If payment is not received within this period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.

ARTICLE 3 – PAYMENT

  1. On the website www.craftgardens.pt, Craft Gardens offers the following payment methods via Easypay – Instituição de Pagamento Lda:

    a) Credit card (Visa, Mastercard);
    b) Multibanco reference;
    c) Bank transfer;
    d) MB Way.

  2. In the case of credit card payment, the charge will be made to the User’s card immediately after confirmation of shipment. If any of the ordered products are out of stock, the corresponding amount will be credited to the User’s card after the order is closed.

ARTICLE 4 – DELIVERY

  1. Orders will be delivered within up to 30 working days after the order is placed. Delivery is carried out by CTT Express.

  2. Shipping costs will be added to the order according to the request, varying according to the total weight of the order.

ARTICLE 5 – PRICES

  1. Prices are stated in Euros, inclusive of taxes and duties, taking into account the VAT rate in force on the date of payment.

  2. If there is a price increase for any product, the User will be informed immediately and may choose to proceed with the order (by paying the difference) or to cancel it.

ARTICLE 6 – CANCELLATION AND RETURNS

  1. The cancellation or return process is handled on a case-by-case basis by Craft Gardens.
    The request must be submitted in writing to info@craftgardens.pt within 15 days of the order. Instructions for cancellation or return will be provided by Craft Gardens via the same communication channel.

  2. Whenever possible, refunds will be made using the same payment method. If this is not possible, the User must provide proof of payment and proof of account or card ownership so that the refund can be made by bank transfer.

  3. Craft Gardens undertakes to refund the User within a maximum period of 14 days.

  4. Returned products must be in saleable condition, i.e., in the same condition in which they were received by the User, without any defect or damage.

  5. If the value resulting from an exchange is lower or higher than the original order value, the settlement conditions will be indicated by Craft Gardens.

ARTICLE 7 – PRIVACY POLICY

The processing of your data is carried out in compliance with personal data protection legislation. Such data, subject to computer processing, will be included in the database(s) of Craft Gardens and are intended for registration and presentation of other products and services, as well as institutional information provided by Craft Gardens.

Providing your data is optional, and the right of access, rectification and deletion of any data that directly concerns you is guaranteed under the law, either in person or in writing, to the address indicated on the homepage of this website.

After payment is completed, Craft Gardens will carry out a standard verification in order to process and ship the order. The customer will receive an e-mail confirming that the order has been paid, together with the corresponding invoice.

Product Availability

All products and/or services available at Craft Gardens may be purchased, except in cases of stock shortages or limitations, as well as made-to-order products, whose availability may vary. Products may become unavailable without prior notice, but in such cases they will be duly identified on Craft Gardens.

If a product becomes unavailable after the purchase has been completed, Craft Gardens undertakes to contact the customer by telephone or e-mail as soon as possible in order to expedite the process.

Taxes and Duties

At Craft Gardens, prices are presented in Euros, with the applicable VAT and taxes in accordance with the law in force, which are already included in the displayed price.

Right of Withdrawal

The customer has the right to terminate the contract within 14 (fourteen) days from the date of conclusion of the contract.

If the customer wishes to withdraw from the contract, they may do so by e-mail to info@craftgardens.pt or by completing the contact form available on Craft Gardens. When withdrawing within the legal period, in addition to returning the product, the customer must also return any gifts accompanying the main product. Craft Gardens shall refund the amount paid within a maximum of 14 days after receipt of the returned order, accompanied by the purchase invoice, proof of payment and return form.

The refund will be made using the same payment method used by the customer for the initial payment, unless otherwise expressly agreed and provided that the customer does not incur any costs as a result of the refund.

Any refund procedure will be processed in accordance with the legislation in force under Decree-Law No. 24/2014.

Complaints

The customer may submit a complaint regarding any matter, act, information or service related to Craft Gardens via e-mail at info@craftgardens.pt or through the electronic complaints book available at: https://www.livroreclamacoes.pt.

Disclaimer of Liability

By creating and using an account at Craft Gardens, the customer is responsible for maintaining the account, its confidentiality, and all activity carried out through the account.

By creating a user account and placing orders, the customer expressly and unequivocally accepts the Terms and Conditions in their most up-to-date version.

Craft Gardens is not responsible for any information disclosed by third parties, technical failures or any other problems that prevent access to or proper functioning of the online store.

Craft Gardens is not responsible for any damage, direct or indirect, related to the use or inability to use the products and/or services provided, nor for any delay or unforeseen event in the delivery of orders.

Applicable Law – Jurisdiction

This contract is subject to Portuguese law and the legislation in force.
